The terms “We” / “Us” / “Our”/”Organization” individually and collectively refer to Bhai Kanahaiya Manav Sewa Trust (BKMS), and the terms “User” refer to the users of the BKMS mobile application (“App”). This page states the Terms and Conditions under which you (User) may use this App. Please read these Terms and Conditions carefully. If you do not accept them, we request that you uninstall and cease using the App. BKMS and any of its divisions, subsidiaries, or affiliated entities reserve the right to revise these Terms and Conditions at any time by updating this section. Users should review these Terms and Conditions periodically, as they are binding on all users of this App.

USE OF CONTENT

All logos, brands, marks, headings, labels, names, signatures, numerals, shapes, or any combinations thereof, appearing in this App, except as otherwise noted, are properties owned or used under license by BKMS and/or its affiliated entities. Unauthorized use of these properties or any other content in this App, except as provided in these Terms and Conditions, is strictly prohibited. You may not modify, sell, reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without prior written permission from the respective organization or entity.

ACCEPTABLE APP USE

(A) Security Rules
Users are prohibited from violating or attempting to violate the security of the App, including, but not limited to:

1. Accessing data not intended for such user or logging into an account the user is not authorized to access.
2. Attempting to probe, scan, or test the vulnerability of the system or network or to breach security or authentication measures without proper authorization.
3. Attempting to interfere with service to any user, host, or network, including, without limitation, via means of submitting a virus or “Trojan horse” to the App, overloading, “flooding,” “mail bombing,” or “crashing.”
4. Sending unsolicited electronic communications, including promotions and/or advertising of products or services.

Violations of system or network security may result in civil or criminal liability. BKMS and/or its affiliated entities will have the right to investigate occurrences they suspect as involving such violations and will have the right to involve and cooperate with law enforcement authorities in prosecuting users involved in such violations.

(B) General Rules
Users may not use the App to transmit, distribute, store, or destroy material:

1. In a manner that could constitute or encourage conduct that would be considered a criminal offense or violate any applicable law or regulation.
2. In a manner that infringes the copyright, trademark, trade secret, or other intellectual property rights of others or violates the privacy or publicity rights of others.
3. That is libelous, defamatory, obscene, threatening, abusive, or hateful.

INDEMNITY

The User agrees to indemnify and hold harmless BKMS, its officers, directors, employees, and agents from and against any claims, actions, demands, liabilities, losses, and damages arising from or resulting from their use of the BKMS mobile App or their breach of these Terms and Conditions.

LIABILITY

The User agrees that BKMS and its affiliated entities, directors, officers, or employees shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use or inability to use the App or from any transactions made through the App, unauthorized access to or alteration of user data, or any other matter relating to the App, including, but not limited to, damages for loss of profits, use, or data, even if BKMS has been advised of the possibility of such damages. The User further agrees that BKMS shall not be liable for any damages arising from interruption, suspension, or termination of the App’s services, whether justified or not, negligent or intentional, inadvertent or advertent. In no event shall BKMS’s total liability to the User for all damages, losses, or causes of action exceed the amount paid by the User to BKMS, if any, related to the cause of action.
